This Privacy Policy applies to information we collect when you use our website www.tanka.chat (the “Site”), mobile applications and other online products and services (collectively, our “Services”).
By downloading, accessing, using and/or interacting with our Services, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Privacy Policy. This Privacy Policy is incorporated by reference into the Terms of Service available at https://www.tanka.chat/agreement/terms-of-service (our “Terms of Service”) and is subject to the provisions of the Terms of Service. Capitalized terms used but not defined in this Privacy Policy shall have the meaning ascribed to such terms in our Terms of Service. If you have any concerns about providing information to us or the use of that information as described in this Privacy Policy you should not use our Services.
Modifications
Because we are always looking for new and innovative ways to help you achieve your goals in connection with the use of our Services, this Privacy Policy may change over time, so please review it frequently. The effective date at the top indicates the last time this Privacy Policy was modified. If we modify the terms of this Privacy Policy, we will notify you by push notification, and/or by posting a notice on our website thirty (30) days prior to the effective date of the changes. If we are required by applicable data protection laws to give you enhanced notice or seek your consent for any such changes, we will do so. We collect information: (i) that you choose to provide to us; and (ii) automatically through your use of our Services.
2. Information We Collect That You Choose To Provide To Us
We collect information that you choose to provide to us:
Account Information. When you create an account on Tanka, you must provide your username, telephone number, email address and password. In order to maintain your basic information and improve your service experience, you can choose to provide additional user profile information, including your gender, avatar, birthday, profession, current or past job history, other professional and employment related information.
Messages. We do not retain your messages in the ordinary course of providing our Services to you. Instead, your messages are stored on your device and not typically stored on our servers. Once your messages are delivered, they are deleted from our servers.
User-Generated Profiles and Content. You may share user-generated graphics, video, livestream, broadcast, or text information (i.e. messages) as you use and communicate through our Services. Users with whom you communicate or share such information can store or reshare your information (including your phone number or messages) with others on and off our Services.
Customer Support and Other Communications. When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any contact or identifying information, any other information you deem helpful. We may collect your communication information with us (including text / picture / audio and video / call record form), and other necessary information related to your request.
Information Others Provide About You. We receive information about you from other users. For example, when other users you know use our Services, they may provide your phone number, name, and other information (like information from their mobile address book) just as you may provide theirs. They may also send you messages, send messages to groups to which you belong, or call you. We require each of these users to have lawful rights to collect, use, and share your information before providing any information to us. You shall also make sure that you have obtained the legal authorization of others before providing the content and information that may involve the personal information of others when using our Services. You should keep in mind that in general any user can capture screenshots of your chats or messages or make recordings of your calls with them and send them to Tanka or anyone else, or post them on another platform.
User Reports. Just as you can report other users, other users or third parties may also choose to report to us your interactions and your messages with them or others on our Services; for example, to report possible violations of our Terms of Services or other policies. When a report is made, we collect information on both the reporting user and reported user.
3. What Information We Collect Automatically When You Use Our Services
We automatically collect information about you including:
Device Information. We collect device-specific information when you access our Services from a computer, mobile, and/or other device, including your hardware model, operating system and version, unique device identifiers, mobile network information, country of access, crash reports, request and referral URL’s and system activity details.
Software Information. We collect software-specific information about your use of our Services, such as which version of our software and what updates you have installed or use, and the presence of required plug ins.
Use Information. We collect information about your use of our Services, including the type of browser you use, the language you prefer, access times, pages viewed, user activity, interactions with other users, your internet protocol address and the page you visited before navigating to our Services.
Information Collected by Cookies. We use cookies to collect information. Cookies are small data files stored on your hard drive or in device memory that helps us to improve our Services and your experience, see which areas and features of our Services are popular and count visits. 4. Information Provided to Us by Third Parties
In addition to the information that we collect directly from you, we also collect certain of your information from following third party sources.
Apple App Store. Our Services that are distributed through the Apple App Store may also request permission to automatically collect other information from your mobile or other device. The Apple App Store may collect information regarding customer activity on the Apple App Store and aggregate that information to understand which part of Apple’s services are of most interest to you. Our Services may only collect such information with your authorization in accordance with your device operating system’s permission process.
Google Play. Our Services that are distributed through Google Play may also request permission to automatically collect other information from your mobile or other device. Google Play may collect device-specific information to help the user decide on which devices the user would like purchases to be available for use. In mobile applications, Google Play may use identifiers specific to your device to serve you more relevant advertisements. More information on Google’s privacy policy can be found here. Our Services may only collect such information with your authorization in accordance with your device operating system’s permission process.
Third Party Services and User Information. We may allow third parties to provide analytics services, such as user behavior analysis, application performance analysis, and provide you with other services, such as text translation in connection with our Services. These third parties may collect information about you on our Services, such as your internet protocol addresses, identifiers associated with your mobile device or applications on the device, the browsers you use to visit our Services, pages viewed, time spent on pages. Some of such third-party analytics and advertising services may offer you a choice to opt-out of the collection and/or sharing of this information. Links to the opt-out mechanisms for the third parties that offer such a choice can be found in the following section, to the extent applicable. We retain your data only for as long as necessary to provide the Services you have requested and thereafter for a variety of legitimate legal or business purposes. These might include retention periods: (i) mandated by law, contract or similar obligations applicable to our business operations; (ii) for preserving, resolving, defending or enforcing our legal/contractual rights; or (iii) needed to maintain adequate and accurate business and financial records.
6. What Kinds of Information We Share
We will share personal information outside of the Company when we have your consent. We’ll ask for your explicit consent to share any sensitive personal information. We do not share your personal information with companies, organizations, or individuals outside of the Company except the following cases:
- In response to a request for information if we believe disclosure is required by or otherwise in accordance with any applicable law, regulation or legal process;
- To protect the rights, property and safety of the Company or others;
- Subject to applicable laws, in connection with any merger, sale of company assets or acquisition of all or a portion of our business; or
- With your consent or at your direction, including if we notify you through our Services that the information you provide will be shared in a particular manner and you provide such information.
We may also share aggregated or de-identified information, which cannot reasonably be used to identify you. When we provide this information, we perform appropriate procedures so that the information does not identify you and we contractually prohibit recipients of the data from re-identifying this information to associate the information with you.
7. How We Keep Your Information Safe
We take commercially reasonable security measures to help protect information we collect about you from loss, theft, misuse, unauthorized access, disclosure, alteration and destruction. These security measures may include practices such as keeping your sensitive data on a secured server behind a firewall, transmitting sensitive information (such as a credit card number) entered while using our Services using secure socket layer technology (“SSL”) and physical security measures to guard against unauthorized access to systems where we store your information. Your information we collect may be stored and processed for the purposes set out in this Privacy Policy within the territory of the United States.
We store information about users on servers primarily located in the State of Oregon, USA. If you are accessing our Services from outside of the United States, please know the data and personal information you submit may be transferred to and stored on servers in the States of Oregon. The data protection and other laws of the relevant states of the United States might not be as comprehensive as those in your country. By submitting your data and/or using our Services, you acknowledge that your data might be transferred, stored and processed in and to relevant states of the United States where we may choose to store or process data. In addition, where we transfer your information to any of the third parties, we also take appropriate steps to ensure that we have implemented appropriate safeguards to ensure that such protection is maintained and is not undermined as a result of that disclosure.
9. Our Policies Regarding Children
As set out in our Terms of Service (available at https://www.tanka.chat/agreement/terms-of-service), our services are not intended for children under the age of thirteen (13) or the minimum age in the relevant territory if that age is older than thirteen (13) (the “Child” or “Children), and we do not knowingly collect any personal information from such Children. Children should not use or attempt to use our Services, and if you are a Child, please do not attempt to use our Services or send any information about yourself to the Company.
In the event that we learn that we have inadvertently gathered personal information from a Child, we will take reasonable measures to delete such information from our records. Parents who believe that we might have gathered any information from or about a Child may submit a request to delete such information to info@tanka.chat or write to our address listed in Section 12 (Contact Us) below.
10. Your Choices and Controls
We give you meaningful choices when it comes to important uses and collection of your information. To easily access, view, update, correct, delete or port your personal data, or to update your subscription preferences, please sign into your account and visit “Account Settings”. Where we rely on consent to collect and use information about you, you can withdraw your consent at any time. If you make a request to delete your personal data and that data is necessary for the products or services you have purchased, the request will be honored only to the extent it is no longer necessary for any Services purchased or required for our legitimate business purposes or legal or contractual record keeping requirements.
Cookies. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.
Push Notifications. We may send push notifications or “alerts” to your device to provide information regarding our Services, service updates, promotional communications and other related messages. You can deactivate push notifications by changing your notification settings via your device.
Some functions of the Services we provide require us to obtain relevant permissions on your device (including but not limited to: address book, location, camera, microphone). When you use the corresponding function, you will see a pop-up reminder requesting your authorization to access certain device functions. You can withdraw the continued authorization of some or all permissions in the setting function of the device at any time. The methods for granting or withdrawing permissions may be slightly different in different devices. Below please find the permissions we may request for providing our Services:
Address Book Authorization. You can use the contact upload feature and provide us, if permitted by applicable laws, with the phone numbers and emails in your mobile address book on a regular basis, including those of both the users of our Services and your other contacts. You can add new friends on Tanka via contacts information synced from you address book. You can sync all or part of your address book, as well as deleting all or part of them. We will store your uploaded contacts information in our server(s). You can manage those uploaded contacts information by creating groups and lists, and such groups and lists are associated with your account information, which can be accessed via different devices.
Camera Authorization. You can use the camera to take photos, capture and upload videos and pictures, and conduct live video, live interaction.
Photo Album and Storage Authorization. You can upload your photos / pictures / videos and locally cached video and audio files by authorizing the access to the photo album, so that you can change your avatar, and send photos / pictures / videos to your Tanka contacts.
Microphone Authorization. You can send voice messages, and make video calls.
Calendar Authorization. You can add reminders created on Tanka to the Calendar to alert you at the right time.
12. How We Respond to Do Not Track Signals
Because consumers are often unaware that their do not track beacons are active, do not track frequently does not reflect the actual preferences of our users. We currently do not respond to Do Not Track signals. In the meantime, you may opt out of certain types of tracking, including certain analytics and tailored advertising by changing your cookie settings.
